Welcome to Bearback. These Terms & Conditions ("Terms") are the agreement between you and Bearback ("Bearback," "we," "us," "our"), based in Anaheim, California. They cover your use of bearbackgear.com (our shop), the Bearback Tribe website and app at bearbacktribe.com, our memberships and subscriptions, and any related features, including our automated assistant "Bruce" (together, the "Services").
We've written these Terms to be clear and fair. Bearback is meant for everyone who belongs here, and we want you to feel welcome — these Terms mostly exist to keep the community safe and to set reasonable expectations on both sides. By using the Services or buying from us, you agree to these Terms. If you don't agree, please don't use the Services.
1. Who Can Use the Services (Eligibility & Age)
Our Services are for adults only. You must be at least 18 years old to use the Bearback shop, and at least 21 years old to access Bearback Tribe. By using a Service, you confirm you meet the minimum age for that Service and that everything you tell us is accurate. Where required, we (or a verification partner) may ask you to confirm or verify your age, and we may decline or revoke access if we can't reasonably confirm eligibility.
2. Your Account, Tribe Membership & Subscriptions
Some features require an account or a Tribe membership. You're responsible for keeping your login secure and for activity under your account. Please give us accurate information and keep it up to date.
Paid memberships and subscriptions (for example, TRIBE+) renew automatically for the period you selected until you cancel. You can cancel at any time, and cancellation takes effect at the end of your current billing period — we don't provide partial-period refunds unless required by law. Prices, perks, and tiers may change over time; we'll give notice of material changes where required, and continued use after a change means you accept it.
You agree to use the community respectfully. Please don't post content that is unlawful, harassing, hateful, infringing, or that shares others' private information without consent. We may remove content or suspend accounts that break these Terms or harm the community, but we're not obligated to monitor everything and we aren't responsible for content posted by members.
3. Age Verification
To keep our platforms adults-only, we may require identity or age verification before you access certain Services (especially Tribe). Verification may be handled by a trusted third-party provider, and access can be denied or removed if verification isn't completed or doesn't confirm eligibility. Information collected for verification is handled as described in our Privacy Policy.
4. The Shop: Orders, Pricing & Made-to-Order Products
Most Bearback products are made to order and/or personal-care items, created specifically for you after you order. Because of this, and for health and hygiene reasons, all sales are final — we do not offer refunds, returns, or exchanges. If something is wrong with your order, email us at support@bearbackgear.com and we'll work with you to make it right. This is summarized in our Refund Policy, which is part of these Terms.
We try to display products, colors, and prices accurately, but we can't guarantee your screen shows colors perfectly, and errors can happen. We may correct errors, change prices, or limit or cancel quantities or orders (including orders that appear to be for resale) at any time, even after an order is placed. Shipping timelines and package protection are described in our Shipping Policy.
5. Bruce and Other AI Tools — Please Read
Bruce and any other automated or AI-assisted features are provided for your convenience and general information only. Here's what that means:
- Bruce gives automated, general responses and product suggestions. It is not a person, and it can be incomplete, out of date, or wrong.
- Anything Bruce says — including product recommendations, availability, deals, usage tips, or answers about orders or policies — is not a guarantee, warranty, or professional advice (including medical, health, legal, or financial advice).
- You should not rely solely on Bruce or any AI output for important decisions. For anything that matters, confirm with us directly at support@bearbackgear.com or check the relevant product page or policy.
- To the fullest extent permitted by law, Bearback is not liable for any loss or harm arising from your reliance on Bruce or any AI-generated content, recommendation, or error. Your use of these tools is at your own discretion and risk.
We're always improving Bruce as the universe grows, and we appreciate your patience if he ever gets something wrong.
6. Acceptable Use
Please don't use the Services to break the law, infringe others' rights, upload harmful code, scrape or harvest data, interfere with security, impersonate others, or use the Services for any unlawful or abusive purpose. We may suspend or end access for conduct that violates these Terms or puts the community at risk.
7. Intellectual Property
The Bearback name, logos, characters (including Bruce), designs, text, and other content are owned by Bearback or our licensors and are protected by law. You may not copy, resell, or exploit any part of the Services without our written permission. If you post content to the community, you keep your rights but grant us a non-exclusive, royalty-free license to display and use that content to operate and promote the Services.
8. Third-Party Tools & Links
The Services may include third-party tools, links, or content we don't control (for example, payment, shipping, or verification providers). We provide these "as is," make no promises about them, and aren't responsible for them. Your use of third-party services is governed by their terms and policies.
9. Disclaimers
The Services and all products are provided "as is" and "as available." To the fullest extent permitted by law, we disclaim implied warranties such as merchantability, fitness for a particular purpose, and non-infringement. We don't guarantee the Services will be uninterrupted, secure, error-free, or that any result or information (including from Bruce) will be accurate or reliable.
10. Limitation of Liability
To the fullest extent permitted by law, Bearback and our owners, team, and partners will not be liable for any indirect, incidental, special, or consequential damages, or for lost profits or data, arising from your use of the Services. Where liability can't be fully excluded, our total liability for any claim will not exceed the greater of the amount you paid us in the 6 months before the claim, or US $100. Some jurisdictions don't allow certain limits, so parts of this section may not apply to you.
11. Indemnification
You agree to reasonably indemnify and hold harmless Bearback and our team and partners from third-party claims and reasonable costs (including attorneys' fees) arising from your misuse of the Services, your content, or your breach of these Terms or of any law or third-party right.
12. If There's a Dispute
We'd much rather sort things out directly and quickly. So before starting any formal proceeding, please email us at support@bearbackgear.com and give us 30 days to try to resolve it with you. Most issues can be fixed with a quick conversation.
If we can't resolve it informally, you and Bearback agree to settle the dispute through binding arbitration on an individual basis in or near Orange County, California, rather than in court, and to waive participation in any class action. This doesn't stop either of us from bringing an individual claim in small-claims court, or from seeking an injunction to protect intellectual property. Nothing here removes any right you can't legally waive.
13. Governing Law
These Terms are governed by the laws of the State of California and the United States, without regard to conflict-of-laws rules.
14. Changes, Termination & Other Terms
Bearback is growing, so we may update these Terms from time to time; the current version will always be posted here, and continued use after changes means you accept them. You may stop using the Services at any time, and we may suspend or end access if these Terms are violated. If any part of these Terms is found unenforceable, the rest still applies. These Terms are the entire agreement between us about the Services and replace any earlier versions.
